This document sets forth the Privacy Policy of the Website (hereinafter referred to as the “Website”).

Personal data collected by the Administrator of the Website are processed in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016. on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation), the Law of May 10, 2018. on the protection of personal data (Journal of Laws 2018, item 1000) and the Act of July 18, 2002. on the provision of electronic services (Journal of Laws No. 144, item 1204). SECURITY OF PERSONAL DATA

The Administrator makes every effort to ensure that the data provided by Users are properly secured: he does not transfer, sell or lend them to any institutions (except with the express consent of the User or at the request of authorized state authorities, i.e. law enforcement agencies, courts, etc. in the case of ongoing proceedings). Any person allowed on the part of SWS SPORTSWEAR SOLUTION to process personal data has been obliged to observe confidentiality. In addition, the Administrator uses appropriate technical and organizational measures to properly secure the personal data of Users processed by him. The addressees of the Services available on the website (in particular, the possibility of placing an Order) are not under 18 years of age. The Administrator does not provide for the purposeful collection of data concerning persons under 18 years of age.

BASIS FOR PROCESSING PERSONAL DATA

Provision of personal data by the Customer is voluntary, although failure to provide the personal data indicated in the Terms and Conditions necessary to conclude a Sales Contract will result in the refusal to conclude a Sales Contract. The data necessary to conclude a Sales Agreement are also indicated each time on the website of the online store. The basis for the processing of the Customer’s personal data is the necessity to execute the contract to which the Customer is a party or to take action at the Customer’s request prior to its conclusion.

SCOPE AND PURPOSE OF PERSONAL DATA PROCESSING

Users’ data is collected by the Personal Data Administrator for the purpose of:

  • for the purpose of saving and ordering, as well as for the execution of the off-premises sales contract (delivery of the purchased Goods), we process personal data provided by you when ordering the Goods, such as your name, e-mail address, address data, payment data;
  • in order to record and execute the agency contract (delivery of the purchased Goods), we process personal data provided by you when ordering the Goods, such as name, email address, address data, payment data;
  • Personal data is used for the implementation of sales contracts, in connection with which it may be transferred to entities responsible for the delivery of purchased goods to the customer, including suppliers cooperating with the seller in the form of dropshipping.
  • For the purpose of processing complaints, complaints and requests and responding to Customers’ inquiries, we process the personal data you provide in the contact form, complaints complaints and requests, or for the purpose of responding to inquiries in another form, and some personal data you provide in the Account, as well as data regarding the order of Goods and other Services provided by us that are the cause of the complaint, complaint or request, and data contained in the documents attached to the complaints, complaints and requests;
  • for the marketing of our Goods and Services and our customers and partners, including remarketing, for this purpose we process personal data provided by you when you create an Account and update it, data about your activity on the Website including orders, which are recorded and stored via cookies, in particular order history, search history, clicks on the Website, login and registration dates, history and your activity related to our communication with you. In the case of remarketing, we use your activity data to reach you with our marketing communications outside of the Website and we use third-party providers for this purpose.   • In order to organize contests and loyalty programs, i.e. notifications of accumulated points, notification of winning and advertising our offer, we use your personal data provided in your Account and when registering for a contest or loyalty program. Detailed information on this subject is provided each time in the terms and conditions of participation of a given contest or loyalty program;
  • for market and opinion research purposes by us or our partners, i.e. order information, your data provided in the Account or during the purchase of Goods, e-mail address. The data collected for market and opinion research is not used by us for advertising purposes. Exact instructions are given in the information about the respective survey or in the place where you enter your data.
  • in order to provide statistics on the use of the various functionalities available on the Website, to facilitate the use of the Website and to ensure the IT security of the Website, we process personal data regarding your activity on the Website and the amount of time spent on each of the subpages on the Website, your search history, your location, your IP address, your device ID, your browser data and your operating system;
  • for the purpose of establishing, investigating and enforcing claims and defending against claims in court proceedings and other enforcement authorities, we may process your personal data provided when ordering Goods or creating an Account and other data necessary to prove the existence of a claim or which arises from a legal requirement, court order or other legal procedure;
  • On our sites, third parties place information in the form of cookies and other similar technologies on your terminal device (e.g. computer, smartphone) and access them. These are our trusted partners with whom we continually work to customize the advertisements on our and their sites, as well as the services we and our trusted partners provide, according to your needs and interests. Such trusted partners are entities in the Wirtualna Polska capital group.

Your provision of the required personal data is voluntary and is a condition for the provision of services by the Personal Data Administrator through the Website.

TIME OF PROCESSING PERSONAL DATA

Personal data will be processed for the period necessary for the execution of orders, services, marketing activities and other services performed for the Customer. Personal data will be deleted in the following cases:

  • when the data subject requests their deletion or withdraws the consent given;
  • When the data subject does not take action for more than 10 years (inactive contact);
  • upon learning that the stored data is outdated or inaccurate.

Some data in the following areas: e-mail address, first and last name, may be stored for a further 3 years for evidence purposes, processing of complaints, claims and claims related to services provided by the Website – this data will not be used for marketing purposes. Data on orders of Goods and paid services, contests and loyalty programs will be stored for a period of 5 years from the date of delivery of the order. We store data on non-logged-in Customers for a period of time corresponding to the life cycle of cookies stored on devices or until they are deleted on the Customer’s device by the Customer. Your personal data regarding your preferences, behavior and choice of marketing content may be used as a basis for automated decisions to determine the sales opportunities of the Website. The Data Controller shall, without undue delay – and in any case within one month of receiving your request – provide you with information about the actions taken in connection with your request. If necessary, the one-month period may be extended for another two months due to the complexity of the request or the number of requests. In any case, the Data Controller will inform you of such extension within one month of receipt of the request, stating the reasons for the delay.

When browsing the Web pages of the Website, “cookies” are used. Their use is aimed at the correct operation of the Website’s web pages.

THE RIGHT TO CONTROL, ACCESS AND DELETE THE CONTENT OF YOUR PERSONAL DATA

  • If you have registered on the Website your personal data can be corrected and supplemented by yourself after logging on to the Website.
  1. You have the right to request the Data Controller to erase your personal data (the “right to be forgotten” (Article 17 RODO) when:

  1. You have the right to request the restriction of the processing of your personal data The right to request the restriction of the processing of your personal data (Article 18 RODO) when:
  • you question the accuracy of your personal data – the Personal Data Controller will restrict the processing of your personal data for a period of time that allows you to verify the accuracy of the data;
  • when the processing of your data is unlawful, and instead of deleting your personal data, you request that the processing of your personal data be restricted;
  • Your personal data is no longer needed for the purposes of processing, but it is needed to establish, assert or defend your claims;
  • when you have objected to the processing of your personal data – until it is determined whether the legitimate interests on the part of the Personal Data Controller override the grounds stated in your objection.

  1. You have the right to object at any time to the processing of your personal data, including profiling The right to object to the processing of personal data (Article 21 of the RODO), in connection with:
  • processing necessary for the performance of a task carried out in the public interest or processing necessary for the purposes of legitimate interests pursued by the Personal Data Controller or a third party;
  • processing for direct marketing purposes.

  1. You have the right to receive your personal data from the Controller in a structured, commonly used machine-readable format and send it to another controller (Right to request personal data portability Article 20 RODO).
  • You may also request that it is the Controller who will directly send your personal data to another controller (if technically possible).

  • Right to withdraw consent
  • You may revoke the consent you have given for the processing of your personal data at any time.
  • Withdrawal of consent to process personal data does not affect the lawfulness of processing carried out on the basis of your consent before its withdrawal.

If you believe that the processing of your personal data violates RODO, you have the right to lodge a complaint with a supervisory authority, in particular in the member state of your habitual residence, your place of work or the place where the alleged violation was committed. In Poland, the supervisory authority under RODO is the President of the Office for Personal Data Protection (PUODO).
